ACCEPTABLE USES AND POLICY

BYTE-HOST.COM customers are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. The customer is expected to have a basic knowledge of how the Internet functions, the types of use which are generally acceptable, and the types of use which are to be avoided.

Content, all services provided by BYTE-HOST.COM may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless BYTE-HOST.COM from any claims resulting from the use of the service which damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all BYTE-HOST.COM servers. This includes sites that may infer sexual content or links to adult content elsewhere. BYTE-HOST.COM will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to BYTE-HOST.COM servers or any other server on the internet. Links to such materials are also prohibited.

Net abuse, including but not limited to activities such as using a non-existent email return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), trolling (posting outrageous messages to generate numerous responses), mailbombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. BYTE-HOST.COM reserves the right to determine what constitutes net abuse. Accounts canceled due to spam will be billed a "clean up" fee of $500

Background Daemons in general are prohibited on BYTE-HOST.COM servers, including, but not limited to, IRC bots, eggdrop, BitchX, XiRCON, warez sites and any other program that interferes with normal server operation.

Policy Violation, If an account is used unlawfully or is in violation of the user policy, BYTE-HOST.COM reserves the right to terminate the account without notice and without refunds. Files that violate the user policy are subject to deletion without notice. Clients violating the User Policy will be held responsible for damages to BYTE-HOST.COM, including but not limited to, BYTE-HOST.COM systems, servers, connectivity, reputation, business, service, network, operations, or equipment and may be assessed a $500 clean up fee. Determining what constitutes a policy violation is the sole discretion of BYTE-HOST.COM.

Web Site Content Management, BYTE-HOST.COM is not responsible for web site management or files lost or damaged by users. Web site construction and management is the responsibility of the client. Client-maintained backup of all site files is recommended, and should be maintained outside of BYTE-HOST.COM's network. System backups are intended to be used in the event of system failures and are not intended to be accessed to restore files to individual sites. A fee of $100 is applicable should a client require any files from our back up systems. We cannot guarantee that the files contained in our backup systems will be the most current copies available for a given site.

BYTE-HOST.COM reserves the right to modify its Acceptable Use Policies from time to time at its discretion.
